Your use of the Site and its contents grants no rights to you in relation to any copyright, designs, trademarks and all other intellectual property and material rights relating to the site content, including any CHRISTOPHER HANLON® Software and/or any HTML or other code contained in this Site. All such content including third party trademarks, designs, images and related intellectual property rights mentioned or displayed on this Site are protected by national intellectual property laws, other laws and international treaty provisions. Use of images: Christopher Hanlon® in accordance with local and international laws of photography and image/model uses hereby makes it publicaly known that content on the www.christopherhanlon.com site featuring model(s) in manners that would lead a reasonable person to believe that the model personally uses or endorses a product or service makes it clear that the person is a model and the Content is being used for illustrative purposes only. You are permitted to use the content on this site only as expressly authorised by CHRISTOPHER HANLON® and/or its third party licensors and may not reproduce, copy or distribute any such images. Any reproduction or redistribution of the above listed content is prohibited and may result in civil and criminal penalties. Without limiting the foregoing, copying and use of the above listed materials to any other server, location or support for publication, reproduction or distribution is also expressly prohibited.

ACCEPTANCE OF YOUR ORDER

Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order. This email is NOT an acceptance of your order, just a confirmation that we have received it.

Unless you cancel your order, acceptance of your order and completion of the contract between you and CHRISTOPHER HANLON® will be completed when we email you to confirm the goods have been dispatched. The sale contract is therefore concluded in Australia and the language of the contract is English. Neither our third party payment processor nor our nominated courier has the authority to accept an order on behalf of CHRISTOPHER HANLON®.

We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorisation for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards or is withdrawn, or that you do not meet the eligibility criteria set out within the T+ C of Sales.

We may also refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any merchandise from the Site whether or not that merchandise has been sold, removing, screening or editing any materials or content on the Site, refusing to process a transaction or unwinding or suspending any transaction after processing has begun. 

Whilst every effort is made to make sure details on our website are accurate, we may from time to time discover an error in the pricing of products. If we discover an error in the pricing of a product in your order, we will let you know as soon as possible. Please note: pictures, illustrations, photographs and written product descriptions used on this Site are representational only. The product, perfume, cosmetic or design in real life may naturally differ as each piece is made by hand in limited quantities. In addition we shall be under no obligation to accept or fulfil an order for a product that was advertised at an incorrect price/description or visual representation; and we reserve the right to cancel such an order that has been accepted or is in transit. If you order a product that is priced incorrectly for any reason, we will email or telephone you to inform you that we have not accepted your order and/or that the relevant part of your order has been cancelled. If you have already paid for the goods, we shall refund the full amount as soon as we are able. In the event that products are recalled in transit, we will process your refund once the products have been returned to us (minus courier/transport charges).


ELIGIBILTY TO PURCHASE

In order to make purchases on the Site you will be required to provide your personal details. In particular, you must provide your real name, phone number, e-mail address and other requested information as indicated. Furthermore, you will be required to provide payment details that you represent and legally authorise; these details must be both valid and correct and you by default confirm that you are the person referred to in the Billing information provided.

The Site is available only to individuals and others who meet the CHRISTOPHER HANLON® terms of eligibility, who have been issued a valid credit/debit card by a bank acceptable to CHRISTOPHER HANLON®, whose applications are acceptable to CHRISTOPHER HANLON® and who have authorised CHRISTOPHER HANLON® to process a charge or charges on their credit/debit card in the amount of the total purchase price for the merchandise which they purchase. CHRISTOPHER HANLON® reserves the right to restrict multiple quantities of an item being shipped to any one customer or postal address.

By making an offer to purchase merchandise you expressly authorise CHRISTOPHER HANLON® to perform credit checks and where CHRISTOPHER HANLON® feels necessary to transmit or to obtain information (including any updated information) about you to or from third parties, including but not limited to your credit/debit card number or credit reports (including credit reports for your spouse if you reside in a community property jurisdiction), to authenticate your identity, to validate your credit/debit card, to obtain an initial credit/debit card authorisation and to authorise individual purchase transactions. 

Furthermore, you agree that we may use personal information provided by you in order to conduct appropriate anti fraud checks. Personal information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.

This Site is for your personal non-commercial use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer, data mine or sell any content, software, products, or services contained within this Site. You may not use this Site, or any of its content, to further any commercial purpose, including any advertising or advertising revenue generation activity on your own Site.


COMPENSATION

At our request, you agree to compensate us fully, defend us, and hold us CHRISTOPHER HANLON® harmless immediately on demand, its officers, directors, agents, affiliates, licensors, and suppliers, from and against all liabilities, claims, expenses, damages and losses, including legal fees, arising from any breach of the T+ C of Sale by you, including the use by any other persons accessing this Site using your Internet account caused by your action or inaction.


OUR RELATIONSHIP

You acknowledge and agree that no joint venture, partnership, employment, or agency relationship exists between you and CHRISTOPHER HANLON® as a result of the T+ C of Sale or your use of this Site. You agree that you may not and will not hold yourself out as a representative, agent, or employee of CHRISTOPHER HANLON®, and we shall not be liable for any representation, act, or omission on your part.


NO WAIVER

If you breach the T+ C of Sale and we take no action against you, we will still be entitled to use our rights and remedies in any other situation where you breach the T+ C of Sale


GOVERNING LAW

Purchase - Terms of ordering, TAXES + DUTIES LIABILITY

The T+ C of Sale together with all our policies and procedures will be governed by and construed in accordance to the relevant Australian law and the relevant courts of Australia will have exclusive jurisdiction.

The www.christopherhanlon.com website may be used to order a selection of CHRISTOPHER HANLON® products from CHRISTOPHER HANLON® AUSTRALIA PTY LTD, directly online via the Internet from Australia for delivery to Australia and Internationally.

You may also place your order by telephone by calling 02-8005 0224 (local call charges apply from within Australia) or +61-(0)414962090 Monday to Sunday, generally between 10.00am to 5.30pm (unless otherwise stated on the Site) when paying with your credit or debit card. 

CHRISTOPHER HANLON® products can be delivered internationally but CHRISTOPHER HANLON® accepts no responsibility for any taxes or other charges that might be levied by International customs. These are the sole responsibility of the purchaser. CHRISTOPHER HANLON® AUSTRALIA does NOT accept responsibility for the delay of any packages retained for customs inspections, payment of duties and/or taxes, etc.

For each product selected on the www.christopherhanlon.com website, a summary page will be displayed automatically featuring a visual or written description of the item, the quantity selected, its unit price and the total amount owed for your order. You should check that this information accurately reflects your selection before confirming your order. Upon confirmation, your order will be submitted to CHRISTOPHER HANLON® for processing. While every effort is taken to try to ensure that the description, colouring, design and style of the CHRISTOPHER HANLON® products in the photographs/representations displayed on the www.christopherhanlon.com website are representative of the actual products, variations may occur due to technical restrictions of artisan (made by hand) manufacturing and the colour reproduction on computer/electronic equipment. Accordingly, CHRISTOPHER HANLON® shall NOT be liable for any error or inaccuracy in the photographs or graphical and written representations of CHRISTOPHER HANLON® products displayed on the www.christopherhanlon.com website.

Once your order has been processed it is not possible to modify any part of the information printed on your receipt/tax invoice such as the billing and/or shipping name and/or address, please ensure all of the details you have provided are correct before finalising your order.

CHRISTOPHER HANLON® reserves the right to cancel any order placed by a customer with whom it has a dispute concerning an order, or if CHRISTOPHER HANLON® has reasonable cause to suspect that such customer has violated these Terms and Conditions of Sale, or is engaged in any fraudulent activity or for any other legitimate cause. If your order has been cancelled, funds that were held on your credit card (in order to secure final payment upon dispatch of your order) will be returned within approximately 30 business days, this time frame is outside of www.christopherhanlon.com Australia’s control and will vary depending on your financial institution and/or type of credit card. www.christopherhanlon.com is unable to issue a refund to expedite this process.

For any special and/or exceptional order (large orders, orders requiring a greater quantity than currently available on www.christopherhanlon.com), please contact our Customer Service by email or telephone. Special and/or exceptional orders will not be accepted for return and/or exchange to www.christopherhanlon.com or any CHRISTOPHER HANLON® boutique or re-seller.

Any exotic skin item (crocodile, alligator, ostrich, lizard etc.) or item with exotic skin components will have a CITES document included with the order, this documentation must always accompany the exotic skin item including for all after-sales purposes. CHRISTOPHER HANLON® will not be able to re-issue a lost CITES document under any circumstances. Due to CITES regulation exotic skin items or items with exotic skin components cannot be exchanged outside of Australia.


Delivery Time - Problems of delivery

Any failure to deliver or late delivery exceeding eight (8) business days should be reported to our Customer Service as soon as possible. In order for your claim to be accepted, please notify us of it within a maximum of fifteen (15) calendar days from the date of confirmation of your order. You should check that your shipment is correct on delivery. If there are any discrepancies in your order when the products are delivered to you, you should note the nature of the potential discrepancy (e.g. open package, damaged goods, etc.) by hand, if possible, on the delivery notice at the time of delivery, and then sign.


Disclaimer of Warranty

The exclusion of or limitations to CHRISTOPHER HANLON® AUSTRALIA PTY LTD liability contained hereunder are made to the full extent permitted by law. Not withstanding any other provision of these Terms and Conditions of Sale, where any law implies any term, condition or warranty which cannot be excluded, restricted or modified at all or only to a limited extent, the term, condition or warranty will apply, except to the extent it can be excluded or limited.

To the extent permitted by law, CHRISTOPHER HANLON®  liability for any breach of any such term, condition or warranty to the extent it can be limited, is limited at CHRISTOPHER HANLON® option, to any one or more of the following:
- in the case of goods:
- the replacement of the goods or the supply of equivalent goods; or
- in the case of services:
- the supplying of the services again

Our goods come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

CHRISTOPHER HANLON® does not guarantee or represent that:
- the www.christopherhanlon.com website is free from viruses, worms, trojan horses or other destructive material;
- the information contained on the www.christopherhanlon.com website is accurate, complete or up to date.
The www.christopherhanlon.com website may contain technical inaccuracies or other defects; CHRISTOPHER HANLON® does not guarantee that any such defects will be corrected.
The www.christopherhanlon.com website and its contents are provided on an ‘as is’ and ‘as available’ basis.


Law - Disputes + PRIVACY POLICY

These Terms and Conditions of Sale and Use shall be governed by and construed in accordance with the laws of New South Wales. Each party irrevocably submits to the non exclusive jurisdiction of the courts of New South Wales and the courts competent to determine appeals from those courts, with respect to any proceedings that may be brought at any time relating to these Terms and Conditions.

How does CHRISTOPHER HANLON® collect your 'personal information'?CHRISTOPHER HANLON® collects 'personal information' about you in the following ways:
- when you visit our website www.christopherhanlon.com;
- when you make a purchase in a CHRISTOPHER HANLON® store or contact us through our call centres;
- when you complete any forms CHRISTOPHER HANLON® provides you with or when you join the Customer Book/Client List or VIP Club;
- when you request a product which is not available and ask CHRISTOPHER HANLON® to notify you of when it will receive additional stock;
- when you leave a product for repair or alteration at an CHRISTOPHER HANLON® store; or
- when you attend an event hosted by us;
- when you apply for employment with us;
- when you join our staff or hand our staff a business card; or
- if you are business providing goods are services to CHRISTOPHER HANLON®, when we enter into a possible arrangement with you for you to provide CHRISTOPHER HANLON® with those goods and services.

Where reasonable and practical, CHRISTOPHER HANLON® will collect your 'personal information' only directly from you. However, we will also collect information about you from third parties, such as a partner or spouse who contacts us on your behalf or from your friends or our external consultants who make provide your 'personal information' to CHRISTOPHER HANLON® in order to invite you to events you may be interested in.

If you provide 'personal information' to CHRISTOPHER HANLON® about someone else, you must ensure that you are entitled to disclose that information to us and that, without CHRISTOPHER HANLON® taking any further steps required by privacy laws, CHRISTOPHER HANLON® may collect, use and disclose such information for the purposes described in this Privacy Policy. For example, you should take reasonable steps to ensure the individual concerned is aware of the various matters detailed in this Privacy Policy. The individual must also provide the consents set out in this Privacy Policy in respect of how we will deal with their personal information.

You may use the www.christopherhanlon.com website without providing any 'personal information' to CHRISTOPHER HANLON® or any other member of the CHRISTOPHER HANLON® group. You will however, need to provide certain information, including your name, address, telephone number and e-mail address, as well as certain financial information (such as your charge or credit card number) if you choose to purchase products offered on the Hermes.com website for the purposes of paying for the products you ordered and processing your order.

*SALES, *OFFERS, *EXCLUSIVE DEALS, *SPECIALS, *Discounts + *VIP PRIVILEGES

CHRISTOPHER HANLON® provides customers the opportunity to indulge in 'offers' often referred to as: *Sales, *Offers, *Exclusive Deals, *Specials, *Discounts and *VIP PRIVILEGES. In most situations these 'offers' are to be used alone and may not be compounded. This is to say a *SALE item could not be purchased using a second or multiple *DISCOUNT or *OFFER, for example. Furthermore, CHRISTOPHER HANLON® reserves the right to null and void any such actions. Generally all 'offers' must be used alone and before the date of expiry (expiry dates are within 2 months of issue unless specified elsewhere). 'Offers' are not redeemable for cash or goods.
